By registering for an account, accessing the Wasika API, or using any Wasika service, you ("Developer" or "you") agree to these Terms and Conditions ("Terms") and our Privacy Policy, which is incorporated by reference.
If you are using Wasika on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to that entity.
These Terms constitute the entire agreement between you and Wasika regarding your use of the platform and supersede all prior agreements.
Wasika provides a multi-channel messaging API ("Service") that enables developers to programmatically send SMS messages, WhatsApp messages, and emails through a single REST API interface.
The Service includes access to the Wasika REST API, optional official SDKs, a developer dashboard, delivery analytics, webhook infrastructure, and developer support.
Wasika reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable prior notice where possible.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your API keys and account credentials. You must not share API keys with unauthorised parties or embed live keys in publicly accessible code repositories.
You are responsible for all activity that occurs under your account. If you become aware of any unauthorised use, you must notify us immediately at security@usewasika.com.
Each account must be associated with one individual or legal entity. Creating multiple accounts to circumvent usage limits or policies is prohibited.
Access to the Wasika API is granted via API keys issued to your account. You must include a valid API key in every request using the Bearer token authentication scheme.
The API is subject to rate limits, which are documented in the API reference and may be adjusted from time to time. Sustained attempts to exceed rate limits, or automated circumvention of limits, may result in temporary or permanent suspension of API access.
You may use the API to build applications, automate workflows, or integrate messaging capabilities into your products, provided such use complies with these Terms and all applicable laws.
You must not use the API in a way that disrupts or degrades the Service for other users. Denial-of-service attacks, load testing against production endpoints without prior written consent, or other abusive usage patterns are strictly prohibited.
You agree not to use the Service to send messages that are unsolicited (spam), deceptive, misleading, or fraudulent. All SMS and WhatsApp messages must comply with applicable opt-in and consent requirements in your target jurisdiction.
The following content is strictly prohibited: illegal content, phishing or credential-harvesting attempts, malware or malicious links, content that promotes violence, hate speech, discrimination, or harassment, sexually explicit content sent without age verification and legal basis, and content that infringes third-party intellectual property rights.
You are solely responsible for ensuring that your use of the Service complies with all laws applicable to you and your recipients, including but not limited to the TCPA (USA), GDPR (Europe), PECR (UK), and equivalent regulations in your jurisdiction.
Wasika reserves the right to inspect message content, suspend delivery of suspected policy-violating messages, and terminate accounts that repeatedly or severely breach this policy.
WhatsApp message templates must be pre-approved through the WhatsApp Business Platform before use. You are responsible for ensuring your templates comply with Meta's WhatsApp Business Policy.
The Service operates on a pay-as-you-go credit basis. There are no monthly fees or minimum commitments. You pre-load your account balance and each sent message deducts from that balance at the applicable per-message rate.
Rates are published on our pricing page and are subject to change with 30 days' notice. Volume discounts apply automatically based on your cumulative monthly message volume across all channels.
Credits added to your account do not expire and carry over indefinitely. Credits are non-refundable except where required by applicable law or at Wasika's sole discretion.
All prices are in US Dollars unless otherwise stated. You are responsible for any applicable taxes, levies, or duties imposed by your jurisdiction.
If payment fails or your balance reaches zero, message delivery will be suspended until the balance is replenished. Wasika is not liable for any losses arising from service interruptions due to insufficient credit.
For Enterprise customers billed by invoice, payment is due within 30 days of the invoice date. Late payments may incur interest at 1.5% per month on the outstanding balance.
By using the Service, you may submit personal data of your end-users (such as phone numbers and email addresses) to Wasika for the purpose of message delivery. You represent and warrant that you have obtained all necessary consents to share such data with us.
Wasika processes personal data in accordance with our Privacy Policy. Where you are a data controller and Wasika acts as a data processor, you may request a Data Processing Agreement (DPA) from us.
Message content is stored for a limited period for delivery logging, debugging, and analytics purposes. You may configure retention periods within the dashboard where applicable.
Wasika implements industry-standard security measures to protect your data. However, no transmission over the internet is 100% secure, and Wasika cannot guarantee absolute security.
The Wasika platform, API, documentation, SDKs, and all associated intellectual property are owned by Wasika and protected by applicable copyright, trademark, and other laws. Nothing in these Terms transfers any ownership rights to you.
Subject to your compliance with these Terms, Wasika grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the API and official SDKs solely for the purpose of building and operating your applications.
You retain ownership of any content or data you transmit through the Service. By using the Service, you grant Wasika a limited licence to process that content solely to provide the Service.
Our official SDKs are open-source and distributed under their respective licences (as stated in each repository). Your use of SDKs is also governed by those licences.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Wasika does not warrant that the Service will be uninterrupted, error-free, or that all messages will be delivered. Message delivery is subject to network conditions, carrier policies, and the availability of third-party messaging infrastructure (including the WhatsApp Business Platform).
Delivery rates, latency, and availability may vary by destination country, carrier, and channel. Wasika publishes uptime statistics and target SLAs but does not guarantee them except where expressly set out in a separate Enterprise agreement.
To the fullest extent permitted by applicable law, Wasika shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm, arising out of or related to your use of the Service.
Wasika's total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the total amount paid by you to Wasika in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, Wasika's liability is limited to the greatest extent permitted by law.
You may terminate your account at any time by contacting support or using the account closure function in the dashboard. Upon termination, your API keys will be revoked and your data will be retained for a period of 30 days before deletion, unless a longer period is required by law.
Wasika may suspend or terminate your access immediately and without prior notice if: (a) you breach these Terms; (b) your usage poses a security risk or legal liability to Wasika or third parties; (c) you engage in fraudulent or abusive activity; or (d) as required by law or a competent authority.
Upon termination for any reason, all rights granted to you under these Terms cease immediately. Any unused credit balance remaining at the time of termination will be refunded within 30 business days, subject to any outstanding charges or obligations.
Wasika reserves the right to update or modify these Terms at any time. We will provide at least 14 days' notice of material changes via email to the address registered on your account and/or via a prominent notice in the dashboard.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Service before the effective date.
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms that cannot be resolved by good-faith negotiation shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from any court of competent jurisdiction.
